If another business or individual appears to be using your name, content, designs or confidential information without permission, the next steps should be considered carefully.
Not every similarity amounts to infringement. The relevant rights, ownership, agreements and evidence all matter.
BEFORE YOU TAKE ACTION
- Keep dated copies of the material you believe has been used.
- Preserve contracts, correspondence and registration details.
- Record where and when the suspected use appeared.
- Avoid sending allegations before your position has been assessed.
Early advice can help identify the most proportionate next step.
OWNERSHIP & PREVENTION
Know Who Owns the Rights Before a Dispute Arises.
Intellectual property ownership can become complicated when work is produced by employees, freelancers, agencies or business partners.
A clear written agreement can reduce uncertainty about who may use, license or transfer the work. When starting a project or entering a commercial relationship, it is worth considering ownership, permissions, confidentiality and what happens if the arrangement ends.

COMMON QUESTIONS
Intellectual Property FAQs.
General information about protecting intellectual property in Scotland and the wider UK.
What does an intellectual property solicitor do?
An intellectual property solicitor advises on legal rights in brands, creative works, designs and confidential information, as well as related agreements and disputes. The appropriate advice depends on the rights and circumstances involved.
Do I need to register copyright in the UK?
There is no general UK copyright registration system. Copyright generally arises automatically in qualifying original works, although ownership and whether protection applies depend on the facts.
Is a company name the same as a registered trademark?
No. Registering a company name does not itself grant the same rights as registering a trademark. Trademark protection and potential conflicts should be considered separately.
Who owns intellectual property created by a freelancer?
Ownership depends on the type of right, the law and any relevant agreement. Paying for work does not always mean all intellectual property rights transfer automatically.
What if someone copies my logo, content or design?
Keep evidence of the original work and suspected copying, along with relevant agreements or registrations. Legal advice can help determine whether a right exists, who owns it and what options may be available.
Can you help with patents?
Patents involve technical and specialist legal requirements. Contact us with a brief description of your matter so we can discuss whether specialist patent advice is needed.
